Registration of individual employment contracts within 20 days after their conclusion to the Territorial Labor Inspectorate (ITM) is no longer mandatory, starting with 1st of January 2011, based on the Emergency Ordinance no. 123/2010.
According to article 298, paragraph 3 of Law no. 53/2003 – Labor Code, starting with 1st January 2011 repeals the Decree no. 92/1976 regarding the workbooks. As a result, starting with 1st January 2011 workbooks will not exist anymore, instead labor records will be performed electronically through the General Register of Employees (REVISAL).
Starting with 1st January 2011:
Individual employment contracts will no longer be registered at ITM, they will be recorded electronically in REVISAL in accordance with legal provisions in force.
The documents regarding execution, amendment, suspension and termination of employment contracts will not longer be submitted at ITM.
Until 25th January 2011:
Employers shall submit to ITM payroll for December 2010.
Employers will pay ITM commission and submit the statement for the month of December 2010.
For January 2011:
Employers will no longer pay the ITM commission.
Employers will no longer prepare and submit the declaration relating to the due commission.
