Procedure for information exchange with employees during martial law in Ukraine: changes and next steps for businesses and employees | News Flash

In accordance with parts three and four of Article 7 of the Law of Ukraine dated 15.03.2022 No. 2136-ИХ “On the Organization of Labor Relations under Martial Law” (as amended), updated rules for the information exchange between the employer and employees have been established.

Obligations for both parties

Both parties to the employment contract – the employee and the employer – are obliged to:

  • ensure constant communication (even during the suspension of the employment contract);
  • notify each other of changes in contact details (address, email, phone) no later than 10 calendar days.

How to notify?

Employer:

  • by updating data in the Unified State Register or by sending a message to the employee’s contacts.

Employee:

  • sends a message to the employer’s address or email specified in the Unified State Register.

    If there is no access to mail or the Internet – you can notify by text message to the employer’s official phone number.

    If one party has not updated its contacts, the other is considered to have notified properly if it has used the last known contacts.

    Exception to the rule

    If there is no technical possibility of communication (postal or electronic), then the notification requirement does not apply – including with regard to:

    • the emergence or termination of labor rights and obligations;
    • suspension or termination of the employment contract.

    Our recommendations

    These changes are aimed at maintaining the efficiency of labor relations and timely exchange of information under martial law.
