Legislative framework for the employment of foreigners in Ukraine

There are several legal provisions in Ukrainian legislation that regulate the process of employment of foreigners, in particular:

  • The Law of Ukraine ‘On Employment of the Population’
  • The Law of Ukraine ‘On the Legal Status of Foreigners and Stateless Persons’
  • The Law of Ukraine ‘On Immigration’
  • The Law of Ukraine ‘On Education’
  • The Law of Ukraine ‘On Stimulating the Development of the Digital Economy in Ukraine’
  • Resolution of the Cabinet of Ministers of Ukraine No. 68 dated 24 February 2023 ‘On Approval of the Technical Description, Sample Form, and Application Forms for Obtaining, Amending and Extending the Validity of a Work Permit for Foreigners and Stateless Persons in Ukraine’

In addition, the Law No. 2623-IX came into force on October 15, 2022, amending the rules for the employment of foreigners in Ukraine. The Article 42-1 of the Law ‘On Employment of the Population’ was updated and the minimum wage requirement for foreigners was cancelled. Previously, work permits were issued on the condition of paying the foreigner at least 10 minimum wages (except for certain categories). Now, foreigners’ salaries must be at least in the amount of the minimum wage, same as for Ukrainian citizens.

The process of obtaining a work permit and its nuances

To hire a foreigner, the employer must obtain a work permit that gives the foreigner official access to the labour market in Ukraine.

There are a few things that the employer should keep in mind:

  • A work permit for foreigners does not grant the right to temporary residence in Ukraine
  • Citizens of most foreign countries may legally stay in Ukraine for up to 90 calendar days
  • If a foreigner plans to stay in the country for more than 90 days, they must additionally obtain a temporary residence permit
  • No special visas are required to obtain the permit, but if you plan to additionally obtain a temporary residence permit in Ukraine, you will need to enter Ukraine based on a D-type visa
  • For employment, a foreigner will additionally need to obtain an individual tax number (TIN)

Work permits for foreigners are issued by the territorial offices of the State Employment Service or administrative service centres. The employer may apply to these authorities in person, through an electronic cabinet on the employment centre’s website, or by mail with a list of attachments.

In most cases, the approval of a work permit takes 7 days. The timeframe for reviewing applications is extended in the case of an application for the employment of a citizen of a country that poses a threat to state sovereignty or other national interests of Ukraine. A work permit can be obtained for a period of up to 3 years, depending on the category of the foreign worker.

There are certain categories of foreigners for whom a permit is required. These include:

  • foreign employees
  • seconded foreign workers
  • intra-corporate assignees
  • foreigners and stateless persons in the process of applying for refugee status or additional protection, as well as foreigners and stateless persons appealing against the refusal to grant these statuses
  • persons who have applied for statelessness and persons who appeal against a refusal to recognise them as stateless
  • foreigners and stateless persons who arrived in Ukraine for the purpose of studying at higher education institutions and intend to carry out labour activity in Ukraine during the period of study and afterwards (on condition of employment no later than 30 calendar days before the completion of studies)

There are also special categories of persons who do not require a work permit for foreigners. These include:

  • foreigners and stateless persons permanently residing in Ukraine
  • foreigners and stateless persons who have been granted refugee status in accordance with the laws of Ukraine or have obtained a permit to immigrate to Ukraine
  • foreigners and stateless persons who have additional or temporary protection in Ukraine
  • representatives of foreign sea (river) fleets and airlines serving such companies in Ukraine
  • persons who are recognised as stateless by the central executive body that implements the state policy in the field of migration (immigration and emigration), including combating illegal migration, citizenship, registration of individuals, refugees and other categories of migrants defined by law
  • employees of foreign media accredited to work in Ukraine
  • athletes who have acquired professional status, artists and art workers to work in Ukraine in their specialty
  • employees of emergency services to perform urgent work
  • employees of branches and representative offices of a legal entity established in accordance with the legislation of a foreign country
  • clergymen temporarily staying in Ukraine at the invitation of religious organisations (with appropriate registration) to carry out canonical activities

What steps should an employer take to successfully employ foreigners?

The procedure for employing foreigners has its own specifics. The employer is responsible for its accuracy and successful completion. Therefore, to avoid possible difficulties, it is important to follow certain actions and requirements for the procedure of obtaining a permit.

The first step is to submit an application in the form established by the Cabinet of Ministers of Ukraine Resolution No. 68 dated 24.02.2023. In this application, the employer confirms that the position in which the foreigner will work is not related to Ukrainian citizenship and does not require access to state secrets in accordance with the laws of Ukraine. In addition to the application, the employer must also attach a certain package of documents and pay a fee for obtaining the permit.

An employment contract with a foreigner is concluded after obtaining a work permit. The employer must submit a certified copy to the employment centre no later than 10 calendar days after signing it. Failure to comply with this obligation within the prescribed period will result in the permit being cancelled.

Employment of foreigners without a work permit is a violation of labour law, which may cause financial and legal complications for the company.
