The minimum gross salary in the construction field in Romania has been increased | News Flash

In the Official Gazette of Romania, Part I, no. 1186 of 09.12.2022, Government Emergency Ordinance no. 168 of 8 December 2022 on some fiscal-budgetary measures, extension of some deadlines, as well as for the amendment and completion of some normative acts (“G.E.O. 168/2022”) was published.

Art. XLI of O.U.G. 168/2022 establishes the new minimum gross wage threshold in the construction sector. Thus, according to the provisions of this article, as from 1 January 2023, for the construction sector, the minimum gross basic wage per country guaranteed in payment is set at RON 4,000 per month, for a normal working schedule averaging 165.333 hours per month, representing an average of RON 24.194 per hour.The scope of the concept of “construction sector” includes the areas of activity referred to in Article 60(5) of the Tax Code, namely:

  1. Construction activity defined in CAEN code 41.42.43 – section F – Construction;
  2. The areas of production of building materials as defined by the following CAEN codes: 2312, 2331, 2332, 2361, 2362, 2363, 2364, 2369, 2370, 2223, 1623, 2512, 2511, 0811, 0812, 2351, 2352, 2399;
  3. Architectural, engineering and technical consulting activities.

This level of the minimum gross basic wage in the country is to be established for the period from 1 January 2023 to 31 December 2028 and will not include bonuses, additions and other allowances for a normal schedule.

The act also regulates the penalties applicable to employers who do not comply with the new legislative changes. Thus, non-compliance with the above-mentioned provisions is considered a misdemeanor and is punishable by a fine ranging from 300 RON to 2,000 RON, while also leading to the cancellation of the tax facilities in Romania.

The legal norm previously regulating the level of the gross minimum wage applicable in the construction sector, namely Article 71 of Government Emergency Ordinance No 114/2018, will be repealed as a consequence of the adoption of G.E.O. 168/2022, effective from 1 January 2023.
