Mandatory e-Delivery in Poland: Everything you need to know | News Flash

Accace - e-Delivery in Poland

Poland implements the e-Delivery service, which in 2025 becomes mandatory for all entrepreneurs registered in National Court Register (KRS) including commercial companies and branch offices.

What is an e-Delivery?

E-Delivery in Poland is a service of registered electronic delivery that enables electronic exchange of correspondence with public authorities.

An entrepreneur who establishes an address for e-Delivery indicates this address as the address for correspondence between the entrepreneur and authorities in Poland (in the future, also courts). It means that authorities using e-Delivery in Poland will send correspondence addressed to the entrepreneur only electronically with the effect of delivery equivalent to registered letter with acknowledgment of receipt.

It should be mentioned that the address for e-Delivery indicated by the entrepreneur is subject to entrance in the National Court Register, and therefore should be updated each time it changes. Failure to update it may result in correspondence being directed by authorities and courts to an outdated address with the effect of proper delivery.

When to set up an e-Delivery address in Poland?

January 1st, 2025: It concerns entrepreneurs registered with the National Court Register starting from January 1st, 2025.

April 1, 2025: It concerns entrepreneurs registered with the National Court Register by January 1st, 2025.

How to set up an e-Delivery address in Poland?

  • To set up an e-Delivery mailbox in Poland, a request must be made to obtain an electronic delivery address (ADE). This should be done through the business.gov.pl platform or with commercial non-public providers in Poland. Entrepreneurs registering in the National Court Register for the first time can include the relevant request already in the very content of the application for registration in the National Court Register submitted through the Court Register Portal.
  • Polish The Minister of Digitization enters ADE into the Database of Electronic Addresses (BAE), which contains the addresses of other entities with an e-Delivery mailbox. Entering the e-Delivery address in BAE means that authorities and, in the future, courts using e-Delivery will send correspondence addressed to the entrepreneur only electronically.
  • Information about the creation of ADE, the e-Delivery mailbox, and instructions for its activation is then sent to administrator’s e-mail address.

The administrator of the e-Delivery mailbox in Poland may be:

  • Legal representative – an individual whose authorization to act results directly from his function, e.g. the only member of the management board of a limited liability company.
  • Attorney – an individual acting based on authorization granted by the entrepreneur.

The e-Delivery mailbox in Poland must have at least one administrator, which should be a person with a PESEL number or European ID.

The administrator’s tasks include receiving, sending and managing correspondence, as well as configuring the e-Delivery mailbox. In addition, the administrator has the authority to grant rights to new users of the e-Delivery mailbox, the scope of which varies, for example: sending and preparing messages or only viewing them.

At any time, it is possible to change the details of the current administrator, as well as to remove the current administrator or replace him with another person. This authority at any time is vested in the owner of the mailbox, who has rights to all scopes of authority and functions within ADE.
