Mandatory activation of electronic mailboxes for legal entities and registered branches in Slovakia | News Flash

On 1 July 2015 the amended Act no. 305/2013 Coll. on the electronic performance of tasks by public authorities (hereinafter referred to as the “Act on e-Government”) came into force. Last year we informed you of the new Act dedicated to establishment of electronic communication with public authorities.

Currently we would like to draw your attention to the fact, that during the transition period starting 1 August 2016 electronic mailboxes of all legal entities and registered branches will be automatically activated. The activation process of electronic mailboxes will be completed on 1 January 2017.

 

Mandatory electronic delivery

Legal entities with the registered office in Slovakia and registered branches could apply for the activation of an electronic mailbox on a voluntary basis until 1 August 2016. From this date the electronic mailboxes will be activated automatically and the organizations are obliged to use them for the electronic delivery. The mandatory activation of electronic mailboxes doesn’t apply to natural persons or natural persons – entrepreneurs.

The activation of electronic mailboxes will serve for the communication with public authorities and the delivery of decisions from public authorities (such as set up a company, get an extract from the Commercial Register and use other online services).

The change effective as of 1 August 2016 resides mainly in the fact, that the process of the mandatory mailbox activation will be implemented automatically based on the legislation. There is no required initial activity from the side of the owner to activate the electronic mailbox. The mailboxes are created and activated automatically by the Government Office of the Slovak Republic.

The activation process will be completed on 1 January 2017.  As of 1 August 2016 electronic mailboxes are activated by the first login of a person authorised to access and operate the electronic mailbox. All the electronic mailboxes of legal entities and registered branches will be activated no later than 1 January 2017.

Electronic mailbox access

The creation of electronic mailboxes is free of charge and succeeds right after creation of a legal entity. All needed information will be provided automatically by the Statistical Office of the Slovak Republic, i.e. there is no need to notify also about the establishment of the new entity.

Access to electronic mailboxes is possible after the previous activation via the Central Government Portal www.slovensko.sk.

Only the members of the statutory body of a legal person are authorised to access the electronic mailbox. After login to the Central Government Portal the authorised person can opt to use it as a natural person – citizen or on the behalf of a legal person.

For authorisation purposes the authorised person needs however a Slovak ID card and personal security code (BOK).

In the case that all members of the statutory body are foreigners who do not own any of the above mentioned documents, it is necessary to authorise another person owning a Slovak ID card with an electronic chip to access and operate the electronic mailbox.

Other natural or legal person can be authorized to access the electronic mailbox via submitting the application that can be found on the webpage www.slovensko.sk. This application has to be signed by the notarized signature and has to be sent to the Government Office of the Slovak Republic.

The delivery of decisions from public authorities pursuant to § 29 paragraph 1 of the Act on e-Government is possible after proper activation of the electronic mailbox.
